Article D224-35 of the French Consumer Code

In the context of an offer to provide maintenance or repair services for equipment requiring the use of a part falling within a category mentioned in article R. 224-32, the trader, before the consumer accepts the offer, allows the consumer to opt for the use of a corresponding part from the circular economy.

The trader shall record, on a durable medium, the consumer’s choice to use this part instead of a new part.

In the event that the trader does not have a corresponding part from the circular economy available at the time of the offer of the service, a clearly and legibly worded statement shall appear under this option stating that the supply of these parts is made subject to the exception provided for in the article R. 224-31 du code de la consommation.

Dans le cadre d’une offre de prestation d’entretien ou de réparation d’un équipement nécessitant l’utilisation d’une pièce relevant d’une catégorie mentionnée à l’article R. 224-32, le professionnel, permet au consommateur, avant que celui-ci accepte l’offre, d’opter pour l’utilisation d’une pièce correspondante, issue de l’économie circulaire.

Le professionnel recueille, sur support durable, le choix du consommateur pour utiliser cette pièce à la place d’une pièce neuve.

Dans le cas où le professionnel ne dispose pas d’une pièce correspondante issue de l’économie circulaire au moment de l’offre de prestation, une mention rédigée de manière claire et lisible figure sous cette option et précise que la fourniture de ces pièces est effectuée sous réserve de l’exception prévue par l’article R. 224-31 du code de la consommation.
