Article L112-4 of the French Insurance Code

The insurance policy is dated the day it is issued. It states :

– the names and residences of the contracting parties ;

– the thing or person insured

– the nature of the risks covered

– the time from which the risk is covered and the duration of this cover;

– the amount of cover;

– the insurance premium or contribution.

The policy also indicates :

– the law applicable to the contract where this is not French law ;

– the address of the insurer’s head office and, where applicable, of the branch providing cover;

– the name and address of the authorities responsible for supervising the insurance company providing the cover.

Policy clauses containing nullities, forfeitures or exclusions are only valid if they are clearly stated.

La police d’assurance est datée du jour où elle est établie. Elle indique :

– les noms et domiciles des parties contractantes ;

– la chose ou la personne assurée ;

– la nature des risques garantis ;

– le moment à partir duquel le risque est garanti et la durée de cette garantie ;

– le montant de cette garantie ;

– la prime ou la cotisation de l’assurance.

La police indique en outre :

– la loi applicable au contrat lorsque ce n’est pas la loi française ;

– l’adresse du siège social de l’assureur et, le cas échéant, de la succursale qui accorde la couverture ;

– le nom et l’adresse des autorités chargées du contrôle de l’entreprise d’assurance qui accorde la couverture.

Les clauses des polices édictant des nullités, des déchéances ou des exclusions ne sont valables que si elles sont mentionnées en caractères très apparents.
