Where the denunciation is made by all the signatory employers or all the signatory employees, the agreement or arrangement continues to have effect until the entry into force of the agreement or arrangement which replaces it or, failing that, for a period of one year from the expiry of the notice period, unless a clause provides for a longer fixed period.
New negotiations shall begin, at the request of one of the interested parties, within three months of the start of the notice period referred to in article L. 2261-9. An agreement may be reached even before the notice period has expired.
The same applies, at the request of one of the representative trade union organisations of the employees concerned, in the event of denunciation of the agreement or convention under the conditions provided for in article L. 2261-12, with regard to the sector concerned by the denunciation.
When one of the employees’ trade union organisations signatory to the agreement loses the status of representative organisation in the field of application of this agreement, the denunciation of this text is only effective if it comes from one or more representative employees’ trade union organisations in its field of application having received a majority of the votes cast under the conditions provided for in Chapter II of Title III.
