Article L5211-16 of the French General Code of Local Authorities

Public establishments for inter-communal cooperation with competence in town planning matters are, on the proposal of the vendors, authorised to acquire, in return for the payment of a life annuity, properties that they require for property restoration, development or equipment operations.

Where a property sold in this way is occupied in whole or in part by the vendor, the life annuity sale contract must include, for his benefit and that of his spouse living with him on the date of the deed of sale, the reservation of a right to live in the said property in whole or in part for their lifetime.

Les établissements publics de coopération intercommunale ayant compétence en matière d’urbanisme sont, sur proposition des vendeurs, autorisés à acquérir, moyennant le paiement d’une rente viagère, les immeubles qui leur sont nécessaires pour des opérations de restauration immobilière, d’aménagement ou d’équipement.

Lorsqu’un immeuble ainsi aliéné est occupé en tout ou partie par le vendeur, le contrat de vente viagère doit comporter à son profit et à celui de son conjoint habitant avec lui, à la date de l’acte de vente, la réserve d’un droit d’habiter totalement ou partiellement ledit immeuble leur vie durant.
