Article L5211-40-1 of the French General Code of Local Authorities

If unable to attend, a member of a committee set up in application of article L. 2121-22 may be replaced for a meeting by a municipal councillor from the same municipality appointed by the mayor. The mayor’s appointment must comply with the principle of proportional representation defined in the last paragraph of the same article L. 2121-22.

When a public establishment for inter-communal cooperation with its own tax status forms a committee under the conditions provided for in article L. 2121-22, it may provide for the participation of municipal councillors from the municipalities that are members of this establishment in accordance with the terms and conditions that it determines.

Elected municipal councillors deputising for the mayor or who have been delegated authority and who are not members of this commission may attend its meetings, without taking part in the votes.

>The mayor may appoint a representative to this commission, who may be a member of this commission.

En cas d’empêchement, le membre d’une commission créée en application de l’article L. 2121-22 peut être remplacé pour une réunion par un conseiller municipal de la même commune désigné par le maire. Ce dernier veille dans sa désignation à respecter le principe de la représentation proportionnelle défini au dernier alinéa du même article L. 2121-22.

Lorsqu’un établissement public de coopération intercommunale à fiscalité propre forme une commission dans les conditions prévues audit article L. 2121-22, il peut prévoir la participation de conseillers municipaux des communes membres de cet établissement selon des modalités qu’il détermine.

Les élus municipaux suppléant le maire ou ayant reçu délégation qui ne sont pas membres de cette commission peuvent assister aux séances de celle-ci, sans participer aux votes.
