Article L524-1 of the French Consumer Code

Following the findings made on the basis of articles L. 511-5 à L. 511-7, the administrative authority responsible for competition and consumer affairs may apply to the civil court or, if appropriate, to the administrative court:
1° to order, where appropriate subject to a fine, the removal of an unlawful, prohibited or unfair term inserted by a professional in any contract or type of contract offered or intended for consumers or non-professionals or in any contract in the course of performance;
2° declare that this term is deemed unwritten in all identical contracts concluded by the same trader with consumers or non-tradesmen;
3° and order the trader to inform the consumers or non-tradesmen concerned at his own expense by any appropriate means.

Article L524-1

A la suite des constatations effectuées sur le fondement des articles L. 511-5 à L. 511-7, l’autorité administrative chargée de la concurrence et de la consommation peut demander à la juridiction civile ou, s’il y a lieu, à la juridiction administrative :
1° d’ordonner, le cas échéant sous astreinte, la suppression d’une clause illicite, interdite ou abusive insérée par un professionnel dans tout contrat ou type de contrat proposé ou destiné aux consommateurs ou aux non-professionnels ou dans tout contrat en cours d’exécution ;
2° de déclarer que cette clause est réputée non écrite dans tous les contrats identiques conclus par le même professionnel avec des consommateurs ou des non-professionnels ;
3° et d’ordonner au professionnel d’en informer à ses frais les consommateurs ou les non-professionnels concernés par tous moyens appropriés.
