Article R111-4-5 of the French Consumer Code

I.-For the application of Article L. 111-4-1, the following sports and leisure articles are subject to the provisions of this article:

1° Bicycles, as defined in Article 1 of Decree no. 2016-364 of 29 March 2016 setting safety requirements for bicycles;

2° Electrically assisted bicycles, as defined in 6.11 of the article R. 311-1 of the Highway Code ;

3° Non-motorised scooters;

4° Leisure tents;

5° Table tennis tables;

> Treadmills
6° Treadmills;

7° Elliptical bikes;

> Exercise bikes
8° Exercise bikes;

9° Rowing machines.
9° Rowers;

II.
II – Manufacturers and importers of the bicycles referred to in I shall ensure that:

1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Wheels
a) Wheels;

b) Pedals;

> c) Axles
c) Bottom bracket axles;

d) Braking systems;

> e) Derailleurs and cables
e) Derailleurs and derailleur cables;

> f) Chains or belts
f) Transmission chains or belts;

> g) Saddles;

> h) Saddles
g) Saddles;

> h) Mudguards and racks
h) Mudguards and luggage racks;

> i) Handles;

i) Handles
i) Handgrips;

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

> a) Forks
a) Forks;

> b) Pedals
b) Pedals;

> c) Sprockets or sprocket sets;

d) Sprockets or sprocket sets
c) Sprocket cassettes or hub-integrated gear change systems;

> d) Handlebars
d) Handlebars;

e) Stems;

f) Frame shock absorbers.

They must also ensure the availability of the spare parts referred to in 1° and 2° for a minimum period of seven years from the date on which the last unit of the model concerned was placed on the national market.

III.
III – Manufacturers and importers of the electrically-assisted bicycles referred to in I must ensure that:

> From the date of placing on the national market of the last model concerned
1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Wheels
a) Wheels;

b) Pedals;

> c) Axles
c) Bottom bracket axles;

d) Braking systems;

> e) Derailleurs and cables

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

IV.
IV -Manufacturers and importers of non-motorised scooters must ensure that:

1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Wheels
a) Wheels;

b) Braking systems;

> c) Folding systems
c) Folding systems;

> d) Mudguards
d) Mudguards;

e) Handgrips;

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

> a) Forks
a) Forks;

> b) Axles
b) Axles;

> c) Handlebars and handlebar tubes
c) Handlebars and handlebar tubes;

They shall also ensure the availability of the spare parts referred to in 1° and 2° for a minimum period of five years from the date on which the last unit of the model concerned was placed on the national market.

V.-Manufacturers and importers of leisure tents must ensure that the following spare parts are available no later than two years after the date on which the first unit of a model is placed on the national market:

a) Poles
a) Masts;

b) Roll-over bars;

They must also ensure the availability of these spare parts for a minimum period of five years from the date on which the last unit of the model concerned was placed on the national market.

VI.
VI – Manufacturers and importers of table tennis tables must ensure that:

1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Wheels
a) Wheels;

b) Braking systems;

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Platforms
a) Platforms;

b) Safety systems;

> c) Feet
c) Feet;

> d) Net poles.

They must also ensure the availability of the spare parts referred to in 1° and 2° for a minimum period of five years from the date on which the last unit of the model concerned was placed on the national market.

VII.
VII – Manufacturers and importers of treadmills must ensure that:

1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Running belts
a) Racing strips;

> b) Racing boards
b) Racing boards;

> c) Running boards;

d) Running boards

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

1° From the date on which the first unit of a model is placed on the national market, that the following spare parts are available:

b) Crankset axles;

c) Pedal arms;

d) Movable arms;

e) Arm castors;

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Control cards;

b) Control cards;

c) Spare parts;

d) Spare parts.

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

X.-Manufacturers and distributors of motorcycles must ensure the availability of the spare parts referred to in 1° and 2°.
X.-Manufacturers and importers of rowing machines must ensure that:

1° From the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

a) Footrests
a) Footrests;

b) Footrest straps;

c) Strap guide rollers;

d) Drawbars;

> e) Saddles;

> f) Saddles

f) Saddle rollers;

2° No later than two years after the date on which the first unit of a model is placed on the national market, the availability of the following spare parts:

They shall also ensure the availability of the spare parts mentioned in 1° and 2° for a minimum period of five years from the date on which the last unit of the model concerned was placed on the national market.

Article R111-4-5

I.-Pour l’application de l’article L. 111-4-1, les articles de sport et de loisirs suivants sont soumis aux dispositions du présent article :

1° Les bicyclettes, telles que définies à l’article 1er du décret n° 2016-364 du 29 mars 2016 fixant les exigences de sécurité concernant les bicyclettes ;

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Roues ;

b) Pédales ;

c) Axes de pédalier ;

d) Systèmes de freinage ;

e) Dérailleurs et câbles de dérailleurs ;

f) Chaînes ou courroies de transmission ;

g) Selles ;

h) Garde-boue et porte-bagages ;

i) Poignées ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Fourches ;

b) Pédaliers ;

c) Cassettes de pignons ou systèmes de changements de vitesses intégrés au moyeu ;

d) Guidons ;

e) Potences ;

f) Amortisseurs de cadre.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de sept ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

III.-Les fabricants et les importateurs de bicyclettes à assistance électrique mentionnées au I assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Roues ;

b) Pédales ;

c) Axes de pédalier ;

d) Systèmes de freinage ;

e) Dérailleurs et câbles de dérailleurs ;

f) Chaînes ou courroies de transmission ;

g) Selles ;

h) Garde-boue et porte-bagages ;

i) Poignées ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Moteurs ;

b) Ecrans de contrôle ;

c) Batteries ;

d) Chargeurs ;

e) Faisceaux électriques ;

f) Capteurs et régulateurs de puissance et de vitesse ;

g) Commandes ;

h) Fourches ;

i) Pédaliers ;

j) Cassettes de pignons ou systèmes de changement de vitesses intégrés au moyeu ;

k) Guidons ;

l) Potences ;

m) Amortisseurs de cadre.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

IV.-Les fabricants et les importateurs de trottinettes non motorisées assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Roues ;

b) Systèmes de freinage ;

c) Systèmes de pliage ;

d) Garde-boue ;

e) Poignées ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Fourches ;

b) Axes ;

c) Guidons et tubes de guidon.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

V.-Les fabricants et les importateurs de tentes de loisir assurent, au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Mâts ;

b) Joncs d’arceaux.

Ils assurent également la disponibilité de ces pièces détachées pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

VI.-Les fabricants et les importateurs de tables de tennis de table assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Roues ;

b) Systèmes de freinage ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Plateaux ;

b) Systèmes de sécurité ;

c) Pieds ;

d) Poteaux du filet.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

VII.-Les fabricants et les importateurs de tapis de course assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Bandes de course ;

b) Planches de course ;

c) Marchepieds ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Cartes de contrôle ;

b) Moteurs ;

c) Batteries ;

d) Interrupteurs ;

e) Consoles ;

f) Vérins de pliage ;

g) Capteurs de vitesse ;

h) Capots inférieurs ;

i) Cordons d’alimentation ;

j) Rouleaux avant et arrière ;

k) Carters ;

l) Dispositifs d’arrêt d’urgence.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

VIII.-Les fabricants et les importateurs de vélos elliptiques assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Pédales ;

b) Axes de pédalier ;

c) Bras de pédales ;

d) Bras mobiles ;

e) Roulettes de bras ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Cartes de contrôle ;

b) Moteurs ;

c) Batteries ;

d) Contrôleurs de tension ;

e) Consoles ;

f) Capteurs ;

g) Interrupteurs ;

h) Galets tendeurs ;

i) Pédaliers monoblocs ;

j) Roues d’inertie ;

k) Croix de manivelle ;

l) Guidons ;

m) Potences ;

n) Vérins ;

o) Rails ;

p) Châssis ;

q) Carters.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

IX.-Les fabricants et les importateurs de vélos d’appartement assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Pédales ;

b) Axes de pédalier ;

c) Sangles pour pédale ;

d) Selles ;

e) Poignées ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Cartes de contrôle ;

b) Moteurs ;

c) Batteries ;

d) Contrôleurs de tension ;

e) Transformateurs ;

f) Consoles ;

g) Capteurs ;

h) Galets tendeurs ;

i) Pédaliers monobloc ;

j) Roues d’inertie ;

k) Axes de plateau ;

l) Guidons ;

m) Potences ;

n) Molettes ;

o) Pieds ;

p) Carters.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.

X.-Les fabricants et les importateurs de rameurs assurent :

1° Dès la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Repose-pieds ;

b) Sangles pour repose-pieds ;

c) Roulettes guide sangle ;

d) Barres de tirage ;

e) Selles ;

f) Roulettes de selle ;

2° Au plus tard deux ans après la date de la mise sur le marché national de la première unité d’un modèle, la disponibilité des pièces détachées suivantes :

a) Cartes de contrôle ;

b) Moteurs ;

c) Batteries ;

d) Contrôleurs de tension ;

e) Transformateurs ;

f) Consoles ;

g) Capteurs ;

h) Galets tendeurs ;

i) Ressorts à spirale ;

j) Câbles mécaniques inférieurs ;

k) Volants d’inertie ;

l) Rails ;

m) Pieds ;

n) Carters.

Ils assurent également la disponibilité des pièces détachées mentionnées aux 1° et 2° pendant une durée minimale de cinq ans à compter de la date de mise sur le marché national de la dernière unité du modèle concerné.
