Any malicious act or attempted malicious act involving a category A, B or C ionising radiation source or batch of radioactive sources, as well as any loss of such sources, shall be reported without delay by the person responsible for the nuclear activity:
1° To the police force with territorial jurisdiction ;
2° The representative of the State in the département where the incident occurred;
3° To the competent authority responsible for monitoring protection against malicious acts;
4° In the case of loss or theft of a source, to the Institute for Radiological Protection and Nuclear Safety;
5° When the event concerns a health establishment or a body responsible for a health service, to the Regional Health Agency.
The person responsible for the nuclear activity must also indicate the measures taken to ensure the protection of persons.
However, when the event occurs in a right of way under the authority of the Minister for Defence or during transport to or from such a right of way, the competent authority designated by the Minister for Defence may authorise the person responsible for the nuclear activity to inform the Regional Health Agency in accordance with 5°.
