Article R211-3 of the French Insurance Code

Professionals involved in the repair, sale or inspection of motor vehicles are obliged to take out insurance to cover their own liability, the liability of persons working on their premises, the liability of persons having custody of or driving the vehicle, even if they have not been authorised to do so, and the liability of passengers.

This obligation applies to the civil liability that the persons mentioned in the previous paragraph may incur as a result of damage caused to third parties by the vehicles entrusted to the policyholder by virtue of his duties and those used in the course of the policyholder’s professional activity.

Les professionnels de la réparation, de la vente ou du contrôle de l’automobile sont tenus de s’assurer, pour leur propre responsabilité, celle des personnes travaillant dans leur exploitation, celle des personnes ayant la garde ou la conduite du véhicule, même sans y avoir été autorisées, ainsi que celle des passagers.

Cette obligation s’applique à la responsabilité civile que les personnes mentionnées au précédent alinéa peuvent encourir du fait des dommages causés aux tiers par les véhicules qui sont confiés au souscripteur du contrat en raison de ses fonctions et ceux qui sont utilisés dans le cadre de l’activité professionnelle du souscripteur du contrat.
