Article R211-33 of the French Tourism Code

The guarantee ceases when it is executed or for the following reasons:

loss of membership of the collective guarantee body or of a group of non-profit-making associations or bodies, or cancellation of the financial guarantee undertaking given by a credit institution, finance company or insurance company;

-removal from the register referred to in article L. 141-3.

A notice announcing the cessation of the guarantee and specifying that it will cease on expiry of a period of three days following publication of the said notice is sent, at the guarantor’s request, by any means enabling an acknowledgement of receipt to be obtained, to the commission mentioned in article L. 141-2, which publishes it on the internet. The notice indicates that any creditors have three months in which to lodge their claims.

If the registered travel operator benefits from a new guarantee granted by another organisation, it must inform the registration commission mentioned in article L. 141-2, which will update the register.

La garantie cesse par son exécution ou pour les raisons suivantes :

-perte de la qualité d’adhérent à l’organisme de garantie collective ou à un groupement d’associations ou d’organismes sans caractère lucratif ou dénonciation de l’engagement de garantie financière pris par un établissement de crédit, une société de financement ou une entreprise d’assurances ;

-radiation du registre mentionné à l’article L. 141-3.

Un avis annonçant la cessation de la garantie et précisant qu’elle cessera à l’expiration d’un délai de trois jours suivant la publication dudit avis est notifié, à la diligence du garant par tout moyen permettant d’en obtenir un accusé de réception à la commission mentionnée à l’article L. 141-2 qui le publie sur internet. L’avis indique qu’un délai de trois mois est ouvert aux créanciers éventuels pour produire leurs créances.

Si l’opérateur de voyages immatriculé bénéficie d’une nouvelle garantie accordée par un autre organisme, il doit en informer la commission d’immatriculation mentionnée à l’article L. 141-2 qui met à jour le registre.
