Article R2122-48-1 of the French Labour Code

The administrative authority shall consult the competent voting operations commission on the compliance of the propaganda documents with the conditions of presentation provided for in the last paragraph of Article R. 2122-52 and in Article R. 2122-52-1. It notifies the candidate trade union organisations whose propaganda documents it has examined of its decision to validate or reject the documents within a period set by order of the Minister responsible for labour. For the propaganda documents mentioned in 1° of article R. 2122-44, the decision is taken by the Director General of Labour. For the other propaganda documents, the decision is taken by the regional director of companies, competition, consumption, labour and employment for which the regional voting commission concerned has its headquarters.

L’autorité administrative consulte la commission des opérations de vote compétente sur la conformité des documents de propagande aux conditions de présentation prévues au dernier alinéa de l’article R. 2122-52 et à l’article R. 2122-52-1. Elle notifie aux organisations syndicales candidates dont elle a examiné les documents de propagande sa décision de valider ou de refuser les documents dans un délai fixé par arrêté du ministre chargé du travail. Pour les documents de propagande mentionnés au 1° de l’article R. 2122-44, la décision est prise par le directeur général du travail. Pour les autres documents de propagande, elle est prise par le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi auprès duquel siège la commission régionale des opérations de vote concernée.
