Article R311-6 of the French Insurance Code

When, pursuant to II of Article L. 311-5, the supervisory board asks a person to draw up a preventive recovery plan, that person has eighteen months to draw up the plan. This period may be reduced to six months by the supervisory board if it considers that this person is likely, within one year, to no longer comply with the conditions of its authorisation provided for in Article L. 321-10 for undertakings authorised in insurance, in Article L. 321-10-1 for undertakings authorised in reinsurance or in Article L. 382-2 for supplementary professional retirement undertakings.

Lorsqu’en application du II de l’article L. 311-5, le collège de supervision demande à une personne d’élaborer un plan préventif de rétablissement, cette personne dispose d’un délai de dix-huit mois pour élaborer ce plan. Ce délai peut être réduit jusqu’à six mois par le collège de supervision si ce dernier estime que cette personne est susceptible, à l’échéance d’un an, de ne plus respecter les conditions de son agrément prévues à l’article L. 321-10 pour les organismes agréés en assurance, à l’article L. 321-10-1 pour les organismes agréés en réassurance ou à l’article L. 382-2 pour les organismes de retraite professionnelle supplémentaire.
