I.-When the resolution board finds that the conditions mentioned in 1° to 4° of III of Article L. 311-18 have been met for a person mentioned in Article L. 311-1, it shall inform that person without delay in accordance with the procedures specified inArticle R. 612-9 of the Monetary and Financial Code.
When, pursuant to the last paragraph of the same III, the resolution college provisionally takes the protective measures listed in Articles L. 311-29 and L. 311-30, it shall inform the person concerned. The person concerned is given five working days to submit its comments in writing. The resolution college shall decide whether to maintain the precautionary measures within two weeks of receiving these observations.
II – The condition stipulated in 2° of III of Article L. 311-18 is assessed on the day a resolution procedure is initiated. To this end, the resolution college may ask the person concerned and the supervisory college to send it without delay any useful information relating to the fulfilment of this condition.
