Once the surveyor(s) have submitted a description of the damage and the other conclusions of the survey, the guarantee fund will pay, within a maximum of three months from the date of submission or, for the properties referred to in II of article R. 421-75 located within the perimeter of the mining disaster, from the date of publication of the order declaring the state of the mining disaster, up to a maximum of 300,000 euros, the amount of compensation awarded to the claimant for the damage mentioned in I of article L. 421-17.
The claimant is presumed to have suffered the damage mentioned in the description drawn up by the expert and the compensation paid by the guarantee fund is presumed to make good this damage under the conditions of II of article L. 421-17 of the Insurance Code when the amount of the compensation is less than 100,000 euros.
If the damage does not meet the conditions laid down in I of article L. 421-17, the guarantee fund shall reject the claim for compensation within three months of the date of submission of the expert’s report, by registered letter with acknowledgement of receipt.
