Article L192-5 of the French Insurance Code

If the contract requires the reconstruction of the damaged building, the payment of the indemnity will not be enforceable against the mortgagee until one month after the insurer has notified the mortgagee that the payment will be made without it being certain that the indemnity will be used for reconstruction.
