Proof of the insurance contract must be in writing.

Before the policy or endorsement is issued, proof of the parties’ commitment may be established by any means, in particular by insurance decree or cover note.

The insurance policy is dated the day it is drawn up. Insurance policies covering civil liability risks must provide that, with regard to this cover, no forfeiture on the grounds of a breach by the insured of its obligations committed subsequent to the loss shall be enforceable against injured parties or their beneficiaries.
