Title IV: New Caledonia and French Polynesia

For its application in New Caledonia and French Polynesia, Article L. 4124-6 reads as follows: “The disciplinary penalties that the disciplinary chamber may impose are as follows: 1° A warning ; 2° a reprimand 3° A temporary ban, with or without a suspended sentence, or a permanent ban from exercising one, several or all of the functions of doctor, dental surgeon or midwife, conferred or remunerated by the State, departments,…

In article L. 4124-8, the words “of the departmental council” are replaced by the words “of the body of New Caledonia or French Polynesia”.

For the application of article L. 4132-5, the words: “and L. 145-2-1 of the Social Security Code” are replaced by the words: “and sentences handed down by the courts responsible for disputes relating to the technical supervision of social security leading to permanent or partial disqualification from membership of a professional body”.

For its application to New Caledonia and French Polynesia, the following is added to article L. 4142-1: “An agreement between the national council of the order and the body of the order of New Caledonia, on the one hand, and that of French Polynesia, on the other hand, sets out the conditions under which the body of the order is represented on the national council and the procedures for coordination…

In New Caledonia and French Polynesia, the court of first instance of the dental surgeons’ association is made up of a disciplinary chamber made up of full assessors and an equal number of alternates elected by the body of the dental surgeons’ association of New Caledonia or that of French Polynesia, or, failing this, by the National Council.

The provisions of articles L. 4441-2, L. 4441-3 and L. 4441-4 to L. 4441-11 are applicable to the disciplinary chamber of the order of dental surgeons of New Caledonia and French Polynesia subject to the following adaptations: the words “doctors” and “doctor” are replaced by the words “dental surgeons” and “dental surgeon” respectively.

In New Caledonia and French Polynesia, the court of first instance of the Association of Midwives is constituted by a disciplinary chamber, the creation of which is subject to the finding by the National Council of the Association that at least thirty midwives are registered on the roll of the Association in New Caledonia or French Polynesia. Until that date, the powers vested in the disciplinary chamber of the Association…

In New Caledonia and French Polynesia, the court of first instance of the Association of Midwives is constituted by a disciplinary chamber composed of full assessors and an equal number of alternates elected by the body of the Association of Midwives of New Caledonia or that of French Polynesia, or, failing that, by the national council.

The provisions of articles L. 4441-2, L. 4441-3 and L. 4441-4 to L. 4441-11 are applicable to the disciplinary chamber of the order of midwives of New Caledonia and French Polynesia subject to the following adaptations: the words “doctors” and “doctor” are replaced by the words “midwives” and “midwife” respectively.
