Subsection 2: Special provisions applicable to tourist offices set up as a public industrial and commercial establishment.

The rules of Section 2 of Chapter I of Title II of Book II of Part Two of the General Local Authorities Code concerning local authorities with legal personality and financial autonomy are applicable to tourist offices constituted in the form of a public industrial and commercial establishment mentioned in the second paragraph of Article L. 133-2, subject to the provisions of this sub-section.

In resorts whose facilities and operation have been the subject of concessions granted by the municipality or municipalities concerned, the creation of a tourist office in the form of a public industrial and commercial establishment may not affect the stipulations of the contracts in force.

The composition of the Tourist Office’s Management Committee and the procedures for appointing its members are laid down by decision of the municipal council or the decision-making body of the public establishment for inter-communal cooperation.

The municipal councillors or members of the public inter-municipal cooperation body who are members of the Office’s Management Committee are elected by the municipal council or by the deliberative body of the public inter-municipal cooperation body for the duration of their term of office. The functions of the other members end when the municipal council is renewed.

The Board elects a Chairman and up to two Vice-Chairmen from among its members. Apart from chairing the Committee meeting if the Chairman is unable to attend, each Vice-Chairman may exercise no powers other than those delegated to him by the Chairman.

The Committee meets at least six times a year. It is also convened whenever the Chairman deems it necessary or at the request of the majority of its members in office. Its meetings are not open to the public.

The Director of the Office attends Committee meetings in an advisory capacity. He keeps the minutes of the meeting and submits them to the Chairman.

The Committee may only deliberate if the number of members present at the meeting exceeds half of the number of members in office. If a Committee member called to a meeting indicates that he/she will be unable to attend, the alternate will be called. Committee decisions are taken by a majority of votes cast. In the event of a tie, the Chairman has the casting vote.
