Subsection 2: Voter information, election campaign and voting operations

An information pack on the subject of the referendum decided by the territorial authority is made available to the public under the conditions laid down by decree in the Conseil d’Etat.

The provisions of Chapter VII of Title I of Book I of the Electoral Code shall apply to local referendums, with the exception of Articles L. 88-1, L. 95 and L. 113-1 (1° to 5° of I, II and III). For the application of these provisions, the text should read: “political group, party or grouping entitled to take part in the campaign” instead of : “candidate” and “list of candidates”.

The regularity of the local referendum may be challenged under the conditions, in the forms and within the time limits prescribed for complaints against the election of members of the deliberative assembly of the territorial authority that decided to organise it.

The provisions of the Electoral Code mentioned in this sub-section are applicable to referendums organised by the communes of Mayotte and Saint-Pierre-et-Miquelon, under the conditions laid down in the following articles of the Electoral Code: 1° For Mayotte: article L. 451 ; 2° For Saint-Pierre-et-Miquelon: articles LO 530 and L. 531.

The provisions of the Electoral Code and those of Law No. 77-808 of 19 July 1977 on the publication and dissemination of certain opinion polls referred to in this sub-section are applicable in their wording resulting from Law No. 2016-1048 of 1 August 2016 renewing the procedures for registering to vote. .
