Section 2: Provisions specific to contracts with a particular purpose

Failing to provide a disabled consumer with the contracts and information they have requested in the form adapted to their disability in breach of article L. 224-2 is punishable by the fine laid down for 5th class offences.

The failure to mention in the electricity or natural gas supply offer the information provided for in article L. 224-3 is punishable by the fine laid down for 5th class offences.

The failure to provide the consumer with an electricity or natural gas supply contract in writing or available on a durable medium under the conditions set out in article L. 224-4 is punishable by the fine laid down for 5th class offences.

The failure to mention in the electricity or natural gas supply contract provided to the consumer the information provided for in article L. 224-7 is punishable by a 5th class fine.

The following are punishable by the fine laid down for 5th class offences: 1° Failure to notify the consumer of any proposed changes to the contractual terms and conditions for the supply of electricity or natural gas in accordance with the provisions of Article L. 224-10; 2° Failure to provide this communication with information on the cancellation option provided for in article L. 224-10.

Failing to provide, at least once a year, billing based on the energy actually consumed in accordance with the provisions of article L. 224-11 is punishable by a 5th class fine.

Supplying an invoice that is not presented in accordance with the provisions determined by order made pursuant to article L. 224-12 is punishable by the fine laid down for 5th class offences.

The fact of charging a consumer, for the termination of their electricity or natural gas supply contract, costs other than those explicitly provided for in the second paragraph of article L. 224-15 is punishable by the fine laid down for 5th class offences.

A repeat offence of the offences punishable under articles R. 242-6 to R. 242-14 shall be punished in accordance with the provisions of articles 132-11 and 132-15 of the Penal Code.
