Article 728-15 of the French Code of Criminal Procedure

The representative of the Public Prosecutor’s Office at the court which handed down the sentencing decision shall be competent to forward to the competent authority of another Member State of the European Union, for the purpose of having that decision recognised and enforced, a copy of the decision and, after having drawn up and signed it, the certificate provided for in Article 728-12.

He may make this transmission at the request of the competent authority of the executing State.

Subject to Article 728-22-1, it may also carry out this transfer on its own initiative or at the request of the person concerned.

It may decide on the transfer where the conditions laid down in Article 728-11 are met and it is satisfied that enforcement of the sentence in the territory of the other Member State will facilitate the social rehabilitation of the person concerned.

Article 728-15

Le représentant du ministère public près la juridiction ayant prononcé la décision de condamnation est compétent pour transmettre à l’autorité compétente d’un autre Etat membre de l’Union européenne, aux fins qu’elle reconnaisse cette décision et la ramène à exécution, une copie de celle-ci et, après l’avoir établi et signé, le certificat prévu à l’article 728-12.

Il peut procéder à cette transmission à la demande de l’autorité compétente de l’Etat d’exécution.

Sous réserve de l’article 728-22-1, il peut également procéder à cette transmission d’office ou à la demande de la personne concernée.

Il peut décider la transmission lorsque les conditions prévues à l’article 728-11 sont réunies et qu’il a acquis la certitude que l’exécution de la condamnation sur le territoire de l’autre Etat membre facilitera la réinsertion sociale de l’intéressé.
