Article 728-17 of the French Code of Criminal Procedure

When the convicted person is on French territory, the representative of the Public Prosecutor’s Office shall conduct or arrange for the convicted person to be heard in order to obtain his or her oral or written observations on the planned transmission. The representative of the Public Prosecutor’s Office shall obtain the convicted person’s consent where this is required pursuant to 3° of Article 728-11. If the convicted person is a minor or is the subject of a protection measure, the court shall also hear or have heard the person responsible for representing or assisting him or her. Minutes are taken of the hearings. Where appropriate, the person responsible for assisting or representing the minor or the person subject to a protective measure may make oral or written observations, which are attached to the file.

Where the sentenced person or the person responsible for representing or assisting him or her on account of his or her minority or a protective measure is in the territory of the executing State, the Public Prosecutor shall request the competent authority of that State to conduct the hearings provided for in the first paragraph of this Article.

Lorsque la personne condamnée se trouve sur le territoire français, le représentant du ministère public procède ou fait procéder à son audition aux fins de recueillir ses observations orales ou écrites sur la transmission envisagée. Il recueille son consentement lorsque celui-ci est requis en application du 3° de l’article 728-11. Si la personne condamnée est mineure ou si elle fait l’objet d’une mesure de protection, il procède ou fait procéder, en outre, à l’audition de la personne chargée de la représenter ou de l’assister. Il est dressé procès-verbal des auditions. Le cas échéant, la personne chargée d’assister ou de représenter le mineur ou la personne faisant l’objet d’une mesure de protection peut faire part de ses observations orales ou écrites, qui sont jointes au dossier.

Lorsque la personne condamnée ou la personne chargée de la représenter ou de l’assister en raison de sa minorité ou d’une mesure de protection se trouve sur le territoire de l’Etat d’exécution, le ministère public demande à l’autorité compétente de cet Etat de procéder aux auditions prévues au premier alinéa du présent article.
