Article L224-25-19 of the French Consumer Code

The trader may refuse to bring the goods into conformity if this proves impossible or would entail disproportionate costs, particularly in the light of the significance of the lack of conformity and the value of the digital content or digital service in the absence of the defect.

Once these conditions have not been met, the consumer may, after formal notice, pursue compulsory performance in kind in accordance with articles 1221 et seq.
If these conditions are not met, the consumer may, after formal notice, pursue compulsory performance in kind of the requested compliance in accordance with articles 1221 et seq. of the Civil Code.

Any refusal by the trader to bring the digital content or digital service into conformity with the contract must be notified to the consumer.
Any refusal by the trader to bring the digital content or digital service into conformity shall be justified in writing or on a durable medium.

Le professionnel peut refuser la mise en conformité si elle s’avère impossible ou entraîne des coûts disproportionnés, au regard notamment de l’importance du défaut de conformité et de la valeur du contenu numérique ou du service numérique en l’absence de défaut.


Dès lors que ces conditions ne sont pas respectées, le consommateur peut, après mise en demeure, poursuivre l’exécution forcée en nature de la mise en conformité sollicitée conformément aux articles 1221 et suivants du code civil.


Tout refus du professionnel de mettre le contenu numérique ou le service numérique en conformité est motivé par écrit ou sur support durable.
