Article L224-34 of the French Consumer Code

The consumer may terminate the contract, free of charge, in the event of a significant, permanent or frequent discrepancy between the actual performance of an electronic communications service, other than an Internet access service, and the performance stated in the contract.

Where, pursuant to the previous paragraph, a consumer terminates a contract for a publicly available electronic communications service before the end of the contractual period, no compensation may be claimed.

Where the consumer chooses to keep subsidised terminal equipment included in the contract, the amount of compensation that may be requested from him in return shall not exceed either the pro rata temporis value agreed at the time of conclusion of the contract, or the amount due, excluding the terminal equipment subsidy, in respect of the unexpired part of the minimum period of performance of the contract. However, if the contract as concluded does not specify the value of this equipment, no compensation is due.
The supplier shall lift any conditions attached to the use of the terminal equipment on other networks free of charge at the latest when the compensation referred to in the previous paragraph is paid.

Le consommateur peut résilier le contrat, sans aucun frais, en cas d’écart significatif, permanent ou fréquent, entre les performances réelles d’un service de communications électroniques, autre qu’un service d’accès à l’internet, et les performances mentionnées dans le contrat.

Lorsqu’en application de l’alinéa précédent, un consommateur résilie un contrat portant sur un service de communications électroniques accessible au public avant la fin de la durée contractuelle, aucune indemnité ne peut lui être demandée.

Lorsque le consommateur choisit de conserver des équipements terminaux subventionnés inclus dans le contrat, le montant de l’indemnité qui peut lui être demandée en contrepartie n’excède ni leur valeur prorata temporis convenue au moment de la conclusion du contrat, ni le montant dû, hors subvention des équipements terminaux, au titre de la fraction non échue de la période minimum d’exécution du contrat. Toutefois, si le contrat tel qu’il a été conclu ne comporte aucune précision sur la valeur de ces équipements, aucune indemnité n’est due.

Le fournisseur lève gratuitement toute condition dont est assortie l’utilisation des équipements terminaux sur d’autres réseaux au plus tard lors du paiement de l’indemnité mentionnée à l’alinéa précédent.
