An online platform operator, within the meaning of article L. 111-7, offering end-users, free of charge, a tool for comparing and evaluating publicly available Internet access service offerings and interpersonal communications service offerings, whether or not based on numbering, with regard to price, the tariff for the services provided and a minimum quality of service offered, may request certification of this tool by the administrative authority responsible for competition and consumption.
To be certified, the comparison tool must :
1° Be operationally independent of the providers of these services;
2° Clearly indicate who the owners and operators are;
3° Set out clear and objective criteria on which the comparison is based;
4° Use clear and unambiguous language;
5° Provide accurate and up-to-date information and indicate the date of the last update;
6° Be open to any provider of Internet access services or publicly available interpersonal communications services that makes the relevant information available and includes a range of offers covering a significant proportion of the market and, where the information presented does not provide a complete overview of the market, must contain a clear statement to that effect, before displaying the results;
7° Provide for an effective procedure for reporting incorrect information;
8° Allow comparison of prices, tariffs and quality of services between offers available to consumers.
An order of the Minister responsible for consumer affairs, issued after consulting the National Consumer Affairs Council, sets out the certification procedures.
The operators mentioned in the first paragraph have the right to use, free of charge and in open data formats, the information published by providers of Internet access services or publicly accessible interpersonal communications services in order to make this information available to consumers by means of their independent comparison tools.
