Article L2261-10 of the French Labour Code

Where the denunciation is made by all the signatory employers or all the signatory employees, the agreement or arrangement continues to have effect until the entry into force of the agreement or arrangement which replaces it or, failing that, for a period of one year from the expiry of the notice period, unless a clause provides for a longer fixed period.

New negotiations shall begin, at the request of one of the interested parties, within three months of the start of the notice period referred to in article L. 2261-9. An agreement may be reached even before the notice period has expired.

The same applies, at the request of one of the representative trade union organisations of the employees concerned, in the event of denunciation of the agreement or convention under the conditions provided for in article L. 2261-12, with regard to the sector concerned by the denunciation.

When one of the employees’ trade union organisations signatory to the agreement loses the status of representative organisation in the field of application of this agreement, the denunciation of this text is only effective if it comes from one or more representative employees’ trade union organisations in its field of application having received a majority of the votes cast under the conditions provided for in Chapter II of Title III.

Article L2261-10

Lorsque la dénonciation émane de la totalité des signataires employeurs ou des signataires salariés, la convention ou l’accord continue de produire effet jusqu’à l’entrée en vigueur de la convention ou de l’accord qui lui est substitué ou, à défaut, pendant une durée d’un an à compter de l’expiration du délai de préavis, sauf clause prévoyant une durée déterminée supérieure.

Une nouvelle négociation s’engage, à la demande d’une des parties intéressées, dans les trois mois qui suivent le début du préavis mentionné à l’article L. 2261-9. Elle peut donner lieu à un accord, y compris avant l’expiration du délai de préavis.

Il en est de même, à la demande d’une des organisations syndicales représentatives de salariés intéressées, en cas de dénonciation de la convention ou de l’accord dans les conditions prévues à l’article L. 2261-12, s’agissant du secteur concerné par la dénonciation.

Lorsqu’une des organisations syndicales de salariés signataires de la convention ou de l’accord perd la qualité d’organisation représentative dans le champ d’application de cette convention ou de cet accord, la dénonciation de ce texte n’emporte d’effets que si elle émane d’une ou plusieurs organisations syndicales de salariés représentatives dans son champ d’application ayant recueilli la majorité des suffrages exprimés dans les conditions prévues au chapitre II du titre III.
