Article L5212-29-1 of the French General Code of Local Authorities

A commune may be authorised, by the State representative in the department following the opinion of the departmental commission for inter-communal cooperation meeting in the formation provided for in the second paragraph of Article L. 5211-45 and in compliance with the provisions of the second to fifth paragraphs of article L. 5212-29, to withdraw from the union in order to join a community of communes, or to withdraw from it one or more of the powers it has transferred to it in application of article L. 5212-16 to transfer them to the community of communes of which it is a member.

The opinion of the departmental commission for inter-communal cooperation is deemed to be negative if it has not been given within two months.

Article L5212-29-1

Une commune peut être autorisée, par le représentant de l’Etat dans le département après avis de la commission départementale de la coopération intercommunale réunie dans la formation prévue au second alinéa de l’article L. 5211-45 et dans le respect des dispositions des deuxième à cinquième alinéas de l’article L. 5212-29, à se retirer du syndicat pour adhérer à une communauté de communes ou à lui retirer une ou plusieurs des compétences qu’elle lui a transférées en application de l’article L. 5212-16 pour les transférer à la communauté de communes dont elle est membre.L’avis de la commission départementale de la coopération intercommunale est réputé négatif s’il n’a pas été rendu à l’issue d’un délai de deux mois.
