Article R2213-8 of the French General Code of Local Authorities

The transport of a deceased person to his or her home or the residence of a member of his or her family before committal is subject to:

1° A written request from the person who is entitled to provide for the funeral and provides proof of his or her civil status and address;

2° The possession of an extract from the death certificate provided for in article L. 2223-42, certifying that the death does not pose a medico-legal problem and that the deceased was not suffering from one of the transmissible infections listed in d of l’article R. 2213-2-1 ;

3° With the agreement, where applicable, of the director of the health establishment or the public or private social or medico-social establishment in which the death occurred;

4° With the prior completion of the formalities prescribed in articles 78,79 and 80 of the Civil Code relating to declarations of death. By way of derogation from the foregoing provisions, in the event of the town hall being closed, these formalities shall be completed as soon as it reopens.

The pre-transport declaration mentioned in article R. 2213-7 indicates the date and presumed time of the operation, the name and address of the duly authorised operator carrying it out, as well as the place of departure and the place of arrival of the body. It refers to the request from the person who is entitled to provide for the funeral.

Le transport avant mise en bière d’une personne décédée vers son domicile ou la résidence d’un membre de sa famille est subordonné :

1° A la demande écrite de la personne qui a qualité pour pourvoir aux funérailles et justifie de son état-civil et de son domicile ;

2° A la détention d’un extrait du certificat de décès prévu à l’article L. 2223-42, attestant que le décès ne pose pas de problème médico-légal et que le défunt n’était pas atteint par l’une des infections transmissibles dont la liste est fixée au d de l’article R. 2213-2-1 ;

3° A l’accord, le cas échéant, du directeur de l’établissement de santé, de l’établissement social ou médico-social, public ou privé, au sein duquel le décès est survenu ;

4° A l’accomplissement préalable des formalités prescrites aux articles 78,79 et 80 du code civil relatives aux déclarations de décès. Par dérogation aux dispositions qui précèdent, en cas de fermeture de la mairie, ces formalités sont accomplies dès sa réouverture.

La déclaration préalable au transport mentionnée à l’article R. 2213-7 indique la date et l’heure présumée de l’opération, le nom et l’adresse de l’opérateur dûment habilité qui procède à celle-ci, ainsi que le lieu de départ et le lieu d’arrivée du corps. Elle fait référence à la demande de la personne qui a qualité pour pourvoir aux funérailles.
