Article R2225-5 of the French General Code of Local Authorities

Prior to setting the measures provided for in article R. 2225-4, a communal external fire defence scheme may be drawn up by the mayor.

This scheme, drawn up in accordance with the departmental regulations mentioned in article R. 2225-3, is intended in particular to:

1° Draw up an inventory of the existing external fire defence;

2° Identify the risks to be taken into account by integrating their foreseeable evolution;

3° Check the adequacy between the existing external fire defence and the risks to be defended;

4° Set the objectives for improving this defence, if necessary;

5° Plan, as necessary, the installation of additional equipment.

This plan takes into account the drinking water distribution plan provided for in Article L. 2224-7-1.

The expertise of the departmental fire and rescue service on the communal external fire defence scheme is sought under the conditions set by the departmental regulations mentioned in article R. 2225-3.

The mayor expressly obtains the opinion of the departmental fire and rescue service and of all the other parties involved in the commune’s external fire defence mentioned in 3° of article R. 2225-3-I before adopting the plan. Each opinion is sent to the mayor within a period that may not exceed two months. In the absence of an opinion within this timeframe, it is deemed to be favourable.

The communal plan is modified and revised at the mayor’s initiative under the conditions set out in the previous paragraphs. Where it includes an equipment plan, it is updated on completion of each phase.

Article R2225-5

Préalablement à la fixation des mesures prévues à l’article R. 2225-4, un schéma communal de défense extérieure contre l’incendie peut être élaboré par le maire.

Ce schéma, établi en conformité avec le règlement départemental mentionné à l’article R. 2225-3, a notamment pour objet de :

1° Dresser l’état des lieux de la défense extérieure contre l’incendie existante ;

2° Identifier les risques à prendre en compte en intégrant leur évolution prévisible ;

3° Vérifier l’adéquation entre la défense extérieure contre l’incendie existante et les risques à défendre ;

4° Fixer les objectifs permettant d’améliorer cette défense, si nécessaire ;

5° Planifier, en tant que de besoin, la mise en place d’équipements supplémentaires.

Ce schéma prend en compte le schéma de distribution d’eau potable prévu à l’article L. 2224-7-1.

L’expertise du service départemental d’incendie et de secours sur le schéma communal de défense extérieure contre l’incendie est sollicitée dans les conditions fixées par le règlement départemental mentionné à l’article R. 2225-3.

Le maire recueille expressément l’avis du service départemental d’incendie et de secours et de l’ensemble des autres acteurs concourant pour la commune à la défense extérieure de l’incendie mentionnés au 3° de l’article R. 2225-3-I avant de l’arrêter. Chaque avis est transmis au maire dans un délai qui ne peut excéder deux mois. En l’absence d’avis dans ce délai, celui-ci est réputé favorable.

Le schéma communal est modifié et révisé à l’initiative du maire dans les conditions prévues aux alinéas précédents. Lorsqu’il comporte un plan d’équipement, il est mis à jour à l’achèvement de chaque phase.
