Article R2333-107 of the French General Code of Local Authorities

Where the works of the public electricity transmission and distribution networks, located on the territory of the municipality, the public establishment for inter-municipal cooperation or the joint association, are operated by separate legal entities, the overall amount of the fee, set in accordance with the procedures laid down in articles R. 2333-105 and 106, is borne by these different legal entities in proportion to the length of the networks they operate on the territory of the municipality, public inter-municipal cooperation body or mixed syndicate concerned. The amount of the fee referred to in article R. 2333-105-2 is borne up to a maximum of one fifth of the fee payable by each for permanent occupation.

Lorsque les ouvrages des réseaux publics de transport et de distribution d’énergie électrique, implantés sur le territoire de la commune, de l’établissement public de coopération intercommunale ou du syndicat mixte, sont exploités par des personnes morales distinctes, le montant global de la redevance, fixé selon les modalités prévues aux articles R. 2333-105 et 106, est supporté par ces différentes personnes morales au prorata de la longueur des réseaux qu’elles exploitent sur le territoire de la commune, de l’établissement public de coopération intercommunale ou du syndicat mixte concerné. Le montant de la redevance mentionnée à l’article R. 2333-105-2 est supporté dans la limite d’un cinquième de la redevance due par chacune au titre de l’occupation permanente.
