Article R421-77 of the French Insurance Code

For the buildings mentioned in II of article R. 421-75 located within the perimeter of the mining disaster, when it is not possible to restore the building on the same plot of land and that, as a result, in application of the provisions of II of article L. 421-17 of the Insurance Code, compensation enables the owner of the damaged building to recover ownership of a building of equivalent consistency and comfort, it is accompanied by the handover of the damaged building to the State free of charge.

Article R421-77

Pour les immeubles mentionnés au II de l’article R. 421-75 situés dans le périmètre du sinistre minier, lorsque la remise en l’état de l’immeuble sur le même terrain n’est pas possible et que, par suite, en application des dispositions du II de l’article L. 421-17 du code des assurances, l’indemnisation permet au propriétaire de l’immeuble sinistré de recouvrer la propriété d’un immeuble de consistance et de confort équivalents, elle s’accompagne de la remise à l’Etat à titre gratuit de l’immeuble sinistré.
