Article 498 of the French Code of Criminal Procedure

Without prejudice to Article 505, the appeal shall be lodged within ten days of the delivery of the contradictory judgment.

However, the time limit for appeal only runs from the service of the judgment regardless of the method of service:

1° For the party who, after adversarial proceedings, was not present or represented at the hearing where the judgment was delivered, but only in the event that he or his representative was not informed of the day on which the judgment would be delivered;

2° For an accused person who was tried in his absence, but after hearing a lawyer who appeared to defend him, without however being the holder of a representation order signed by the accused;

3° For an accused person who did not appear in the case provided for in the fifth paragraph of article 411, where his lawyer was not present.

The same applies in the cases provided for in Articles 410 and 494-1, subject to the provisions of l’article 498-1.

Article 498

Sans préjudice de l’article 505, l’appel est interjeté dans le délai de dix jours à compter du prononcé du jugement contradictoire.

Toutefois, le délai d’appel ne court qu’à compter de la signification du jugement quel qu’en soit le mode :

1° Pour la partie qui, après débat contradictoire, n’était pas présente ou représentée à l’audience où le jugement a été prononcé, mais seulement dans le cas où elle-même ou son représentant n’auraient pas été informés du jour où le jugement serait prononcé ;

2° Pour le prévenu qui a été jugé en son absence, mais après audition d’un avocat qui s’est présenté pour assurer sa défense, sans cependant être titulaire d’un mandat de représentation signé du prévenu ;

3° Pour le prévenu qui n’a pas comparu dans le cas prévu par le cinquième alinéa de l’article 411, lorsque son avocat n’était pas présent.

Il en est de même dans les cas prévus par les articles 410 et 494-1, sous réserve des dispositions de l’article 498-1.
