Article R2131-3 of the French Public procurement code

When a contracting entity publishes a periodic indicative notice, it shall communicate to candidates who so request the technical specifications that it usually includes or intends to include in contracts having the same subject as that mentioned in the notice.
These technical specifications are made available on a buyer profile under the conditions set out in articles R. 2131-2, R. 2131-4,R. 2131-5 and R. 2131-6. However, they shall be transmitted by other means in the following cases:
1° When it is not possible to offer free, unrestricted, full and direct access by electronic means to certain consultation documents for one of the reasons mentioned in R. 2132-12 and R. 2131-14 ;
2° When the contracting entity intends to impose requirements on economic operators in order to protect the confidentiality of the information that it makes available throughout the procurement procedure.

Article R2131-3

Lorsqu’une entité adjudicatrice publie un avis périodique indicatif, elle communique aux candidats qui le demandent les spécifications techniques qu’elle fait habituellement figurer ou qu’elle entend faire figurer dans les marchés ayant le même objet que celui mentionné dans l’avis.
Ces spécifications techniques sont mises à disposition sur un profil d’acheteur dans les conditions fixées aux articles R. 2131-2, R. 2131-4,R. 2131-5 et R. 2131-6. Toutefois, elles sont transmises par d’autres moyens dans les cas suivants :
1° Lorsqu’il n’est pas possible d’offrir un accès gratuit, sans restriction, complet et direct par voie électronique à certains documents de la consultation pour une des raisons mentionnées aux R. 2132-12 et R. 2131-14 ;
2° Lorsque l’entité adjudicatrice entend imposer aux opérateurs économiques des exigences visant à protéger la confidentialité des informations qu’elle met à disposition tout au long de la procédure de passation.
