The municipal council or the deliberative body of the public establishment responsible for all or part of the public collective or non-collective sanitation service institutes a sanitation fee for the part of the service it provides and sets the rate.
When the sanitation service covers both collective and non-collective sanitation, two separate charges are introduced. The budget attached to the sanitation service or the joint water and sanitation budget established under the conditions set by article L. 2224-6 or the summary statement mentioned in article L. 2221-11 must show in a supplementary statement the breakdown between operations relating to collective and non-collective sanitation respectively. The administrative account must show this breakdown in the same way.
In the event of the sanitation service being delegated, the rate of the fee may include, in addition to a portion, set by the delegation agreement, due to the delegatee in respect of the costs of the service it provides, a portion due to the delegating authority intended to cover the expenses that remain its responsibility.
