Article R311-22 of the French Insurance Code

In exercising their powers, the college of supervisors and the college of resolution assess the potential effects of disclosure of information relating to the person concerned or to the resolution procedure. In particular, they assess the potential effects of disclosing information contained in the preventive recovery plan referred to in Article L. 311-5 and in the preventive resolution plan referred to in Article L. 311-8.

On the basis of this assessment, the colleges shall ensure that the assignees, prospective assignees, trustees and bridge institutions concerned have procedures in place to limit the risk of disclosure of information that could prejudice the resolution procedure.

Dans l’exercice de leurs pouvoirs, le collège de supervision et le collège de résolution évaluent les effets potentiels de la divulgation des informations relatives à la personne concernée ou à la procédure de résolution. Ils apprécient, en particulier, les effets que pourraient avoir la divulgation des informations contenues dans le plan préventif de rétablissement mentionné à l’article L. 311-5 et dans le plan préventif de résolution mentionné à l’article L. 311-8.


En fonction de cette évaluation, les collèges veillent à ce que les cessionnaires, les candidats cessionnaires, les fiduciaires et les établissements-relais concernés se dotent de procédures qui permettent de limiter les risques de divulgation d’informations susceptibles de nuire à la procédure de résolution.
