Without prejudice to the provisions laying down a specific procedure, when the Board is called upon to issue an opinion on an individual case, it shall invite the person concerned to make his observations and shall hear him if he so requests.

On the proposal of the Chairman and with the agreement of two-thirds of its members, the Board meets in restricted formation on a specific agenda. The restricted formation includes at least one member from each of the categories listed in article R. 1416-17.

Prior to the adoption of an order for the treatment of insalubrity in application ofarticle L. 511-11 of the Code de la construction et de l’habitation, the competent authority may refer the matter to the Conseil départemental de l’environnement et des risques sanitaires et technologiques for an opinion.
