The Conseil supérieur de la prud’homie issues opinions and suggestions. It carries out studies on the organisation and operation of industrial tribunals.
The Conseil supérieur de la prud’homie proposes any measures it deems useful to the Minister of Justice and the Minister of Labour. These ministers may refer to it for an opinion on any matter falling within its remit.
The Conseil supérieur de la prud’homie is consulted on draft laws and regulations relating to : 1° The establishment, jurisdiction, organisation and operation of industrial tribunals; 2° The appointment, status and training of industrial tribunal members; 3° The procedure followed before industrial tribunals; 4° Decrees issued pursuant to Article L. 1422-3.
The Conseil supérieur de la prud’homie draws up a code of conduct for councillors, which is made public.
The Conseil supérieur de la prud’homie comprises, in addition to the chairman : 1° Five members representing the State: a) Two representatives of the Minister of Justice ; b) Two representatives of the Minister of Labour; c) One representative of the Minister of Agriculture; 2° Eleven members representing employees, appointed on the recommendation of representative national trade unions; 3° Eleven members representing employers, appointed on the recommendation of representative organisations…

An equal number of employer and employee substitutes are appointed under the same conditions as the full members. They sit only in the absence of the full members. If the chairman is unable to attend, he is replaced by one of the representatives of the Minister of Justice.
The Chairman and the full and alternate representatives of employers and employees are appointed by joint order of the Minister of Justice and the Minister of Labour, for a renewable term of four years. In the event of death, resignation or loss of office, the members are replaced. The successor remains in office until expiry of the normal term of office of the member replaced.
The duties of a member of the Conseil supérieur de la prud’homie are not remunerated. Travel and subsistence expenses incurred by the members of the Council and the persons mentioned in article R. 1431-16 may give rise to reimbursement. This reimbursement is made under the conditions set by joint order of the Minister of Justice, the Minister of Labour and the Minister of the Budget.
