Title I: Aid from the Centre National du Cinéma et de l'Image Animée

Operators of cinematographic entertainment establishments may opt to specialise one or more cinematographic entertainment venues in the showing of pornographic cinematographic or audiovisual works or documents appearing, as such, on the list provided for in Article L. 311-2. The option is exercised theatre by theatre.

An exhibitor may opt for the specialisation of a cinema provided that the majority of its programming, during the cinematographic quarter preceding that in which the option is exercised, consists of cinematographic or audiovisual works or documents of a pornographic nature appearing, as such, on the list provided for in Article L. 311-2. The President of the Centre national du cinéma et de l’image animée is notified of the decision to specialise one or more cinemas.Unless the President objects on the grounds of non-compliance with the provisions of this section, the specialisation of a cinema takes effect on the first day of the cinematic quarter following the date of receipt of the notification provided for in the previous paragraph.

Cinema operators who have opted to specialise one or more cinemas are not eligible for aid for the cinemas in question.

The President of the Centre National du Cinéma et de l’Image Animée is notified of the decision to renounce the specialisation of a cinema for approval.Approval prevents the cinema from being re-specialised for a period of one year from the date of approval.

When the operator of a cinema that has opted for the specialisation provided for in article D. 311-5 waives the waiver, automatic grants are calculated from the date on which the waiver is approved.
