Contracting entities may use a qualification system established by a third party. They shall inform the economic operators concerned thereof.
In order to set up a qualification system, the contracting entity shall publish a notice of the existence of such a system under the conditions laid down in Articles R. 2131-19 and R. 2131-20. The contracting entity shall notify the Publications Office of the European Union of any change in the duration of the system using:1° A notice of the existence of a qualification system when its period of validity is changed without it being terminated;2° An award notice when the system is terminated.
The qualification system may comprise several qualification stages. The contracting entity shall establish objective rules and criteria for the exclusion and selection of economic operators requesting qualification and objective rules and criteria for the operation of the qualification system, covering aspects such as registration in the system, periodic updating of qualifications and the duration of the system. Contracting entities shall ensure that economic operators may at any time request to be qualified. The rules and criteria for qualification shall be communicated to them at their request. Updated rules and criteria shall be communicated to all interested economic operators. Economic operators are informed of decisions relating to their qualification under the conditions set out in Articles R. 2181-5 and R. 2181-6.
Contracting entities may only terminate the qualification of an economic operator for reasons based on the rules and criteria mentioned in Article R. 2162-30. The intention to terminate the qualification shall be notified to this operator in advance, in writing, stating the reasons, at least fifteen days before the date set for terminating the qualification.
A list of qualified economic operators is kept. It can be divided into categories by type of contract for which the qualification is valid.
Where fees are charged for applications for qualification or for updating or maintaining a qualification already obtained under the system, they shall be proportionate to the costs incurred.

Where certain consultation documents are not published on a buyer profile because the contracting entity imposes requirements on the selected participants to protect the confidentiality of certain information, the contracting entity shall indicate in the consultation documents the measures it imposes to protect the confidentiality of the information and the arrangements for access to the documents concerned.
