Article 728-62 of the French Code of Criminal Procedure

A person transferred to French territory for the enforcement of a custodial sentence or detention order imposed by a court of a Member State may not be sought, prosecuted, sentenced or detained for any act prior to his transfer, other than that for which he was transferred, unless he is in one of the following cases:

1° Having had the opportunity to do so, he or she has not left the national territory within forty-five days of his or her final release, or has voluntarily returned to it after leaving it;

2° The offence is not punishable by a custodial sentence or detention order;

3° No custodial or restrictive measure is applied during the proceedings in respect of the offence charged;

4° The convicted person is not liable to a custodial sentence or measure involving deprivation of liberty in respect of this offence;

5° He or she has consented to the transfer;

6° He or she has expressly renounced, after his or her transfer, before the criminal court of the place where the sentence is to be served and under the conditions provided for in the last two paragraphs of Article 695-19, to the benefit of the rule of speciality provided for in the first paragraph of this article, his waiver being irrevocable;

7° The competent authority of the sentencing State expressly consents to this rule being disregarded.

Article 728-62

La personne transférée sur le territoire français pour la mise à exécution d’une condamnation à une peine ou à une mesure de sûreté privative de liberté prononcée par une juridiction d’un Etat membre ne peut être recherchée, poursuivie, condamnée ou détenue pour un fait quelconque antérieur à son transfèrement, autre que celui qui a motivé celui-ci, sauf si elle se trouve dans l’un des cas suivants :

1° Ayant eu la possibilité de le faire, elle n’a pas quitté le territoire national dans les quarante-cinq jours suivant sa libération définitive, ou y est retournée volontairement après l’avoir quitté ;

2° L’infraction n’est pas punie d’une peine ou d’une mesure de sûreté privative de liberté ;

3° Aucune mesure privative ou restrictive de liberté n’est appliquée durant la procédure suivie du chef de l’infraction reprochée ;

4° La personne condamnée n’est pas passible d’une peine ou d’une mesure privative de liberté en répression de cette infraction ;

5° Elle a consenti au transfèrement ;

6° Elle a renoncé expressément, après son transfèrement, devant le tribunal correctionnel du lieu d’exécution de la peine et dans les conditions prévues aux deux derniers alinéas de l’article 695-19, au bénéfice de la règle de la spécialité prévue au premier alinéa du présent article, sa renonciation étant irrévocable ;

7° L’autorité compétente de l’Etat de condamnation consent expressément que cette règle soit écartée.
