Article D125-1-2 of the French Insurance Code

Decisions adopted by ministers to recognise or not to recognise communes as being in a state of natural disaster may be the subject of administrative appeals under the conditions laid down by the provisions of the Code des relations entre le public et l’administration (Code of relations between the public and the administration). They may also be contested before the competent administrative courts under the conditions set out in the provisions of the Code of Administrative Justice.

The interministerial order referred to in the fourth paragraph of article L. 125-1 specifies the channels and time limits within which such appeals may be lodged.

Les décisions de reconnaissance ou de non-reconnaissance des communes en état de catastrophe naturelle adoptées par les ministres peuvent faire l’objet de recours administratifs dans les conditions prévues par les dispositions du code des relations entre le public et l’administration. Elles peuvent également être contestées devant les juridictions administratives compétentes dans les conditions prévues par les dispositions du code de justice administrative.


L’arrêté interministériel visé au quatrième alinéa de l’article L. 125-1 mentionne les voies et les délais dans lesquels ces recours peuvent être exercés.
