Article D2224-3 of the French General Code of Local Authorities

The municipal council of each municipality that is a member of a public establishment for inter-municipal cooperation shall receive the annual report adopted by this establishment.

In each municipality that has transferred at least one of its competencies in the field of drinking water or sanitation or the prevention and management of household and similar waste to one or more public establishments for inter-municipal cooperation, the mayor presents to the municipal council, no later than twelve months following the close of the financial year concerned, the annual report(s) that he has received from the public establishment(s) for inter-municipal cooperation mentioned above. It shall indicate, in an introductory note:

– the exact nature of the service provided by this or these public establishments of intermunicipal cooperation and, where applicable, what falls under the direct management of the municipality concerned;

– the total price of water and its various components, using the indicators mentioned in Annexes V and VI of this code.

– the total price of waste prevention and management and its various components, and its financing, using the indicators mentioned in Annex XIII.

These reports are, where applicable, presented within the same timeframe to the consultative commission for local public services provided for in article L. 1413-1.

Le conseil municipal de chaque commune adhérant à un établissement public de coopération intercommunale est destinataire du rapport annuel adopté par cet établissement.

Dans chaque commune ayant transféré l’une au moins de ses compétences en matière d’eau potable ou d’assainissement ou de prévention et de gestion des déchets ménagers et assimilés à un ou plusieurs établissements publics de coopération intercommunale, le maire présente au conseil municipal, au plus tard dans les douze mois qui suivent la clôture de l’exercice concerné, le ou les rapports annuels qu’il aura reçus du ou des établissements publics de coopération intercommunale ci-dessus mentionnés. Il indique, dans une note liminaire :

– la nature exacte du service assuré par ce ou ces établissements publics de coopération intercommunale et, le cas échéant, ce qui relève de la gestion directe de la commune concernée ;

– le prix total de l’eau et ses différentes composantes, en utilisant les indicateurs mentionnés aux annexes V et VI du présent code.

– le prix total de la prévention et de la gestion des déchets et ses différentes composantes, et son financement, en utilisant les indicateurs mentionnés à l’annexe XIII.

Ces rapports sont, le cas échéant, présentés dans les mêmes délais à la commission consultative des services publics locaux prévue à l’article L. 1413-1.
