Article R131-3 of the French Sports Code

Sports federations applying for approval under article L. 131-8 must :

1° Have adopted statutes containing provisions guaranteeing the democratic nature of their elections and operation, the transparency of their management and equal access for women and men to their governing bodies, and which include the mandatory provisions set out in Annex I-5;

2° Have adopted disciplinary rules that comply with the standard disciplinary rules set out in Appendix I-6. In this case, where the notification of grievances to the parties concerned predates the date of entry into force of the disciplinary regulations complying with the standard disciplinary regulations, the disciplinary proceedings initiated by the federations shall remain subject to the provisions previously applicable;

Sports federations may adopt disciplinary regulations containing provisions in addition to those in the standard disciplinary regulations;

The Minister responsible for sport shall check that the disciplinary regulations adopted comply with the standard disciplinary regulations;

3° Have signed the Republican Commitment Contract referred to in article L. 131-8, which is appended to the Articles of Association, as well as the additional commitments provided for in article R. 131-11;

4° Prove that they have been in existence for at least three years;

5° Prove that they are able to participate in the implementation of public service missions relating to the development and democratisation of physical and sporting activities and to offer their members the administrative structures and technical supervision required for the practice of the discipline and the protection of the physical and moral integrity of individuals, in particular minors.

Article R131-3

Les fédérations sportives qui sollicitent l’agrément prévu à l’article L. 131-8 doivent :

1° Avoir adopté des statuts comportant des dispositions qui garantissent le caractère démocratique de leurs élections et de leur fonctionnement, la transparence de leur gestion et l’égal accès des femmes et des hommes à leurs instances dirigeantes, et qui comprennent les dispositions obligatoires prévues à l’annexe I-5 ;

2° Avoir adopté un règlement disciplinaire conforme au règlement disciplinaire type figurant à l’annexe I-6. Dans ce cas, lorsque la notification des griefs aux intéressés est antérieure à la date d’entrée en vigueur du règlement disciplinaire conforme au règlement disciplinaire type, les procédures disciplinaires engagées par les fédérations restent soumises aux dispositions antérieurement applicables ;

Les fédérations sportives peuvent adopter un règlement disciplinaire comportant des dispositions complémentaires à celles du règlement disciplinaire type ;

Le ministre chargé des sports contrôle la conformité du règlement disciplinaire adopté au règlement disciplinaire type ;

3° Avoir souscrit le contrat d’engagement républicain mentionné à l’article L. 131-8, qui est annexé aux statuts, ainsi que les engagements complémentaires prévus à l’article R. 131-11 ;

4° Justifier d’une existence d’au moins trois ans ;

5° Justifier qu’elles sont en mesure de participer à la mise en œuvre des missions de service public relatives au développement et à la démocratisation des activités physiques et sportives et d’offrir à leurs membres les structures administratives et l’encadrement technique que requièrent la pratique de la discipline et la protection de l’intégrité physique et morale des personnes, en particulier des mineurs.
