Article R2213-34-1 of the French General Code of Local Authorities

I.-When the body of the deceased has been placed, in order to ensure its transport, in a coffin made of a material that presents an obstacle to cremation, the authorisation to transfer the body to a coffin suitable for cremation, provided for in article L. 2223-42-1, is issued by the mayor of the municipality of the place where the coffin is opened and changed, at the request of the person entitled to provide for the funeral.

The request must be made in writing and sent by any means. It shall be accompanied by the evidence provided for in article R. 2213-34 and a medical certificate stating that the deceased was not suffering from a transmissible infection included in the lists mentioned in a and b of article R. 2213-2-1. This certificate is drawn up by a health professional practising at the place of death.

II.-On the basis of the evidence required and subject to the provisions of 3° of article R. 2213-26, the mayor shall issue authorisation for the body to be transferred to a coffin suitable for cremation. This authorisation is issued free of charge and can be sent by electronic means. It is equivalent to authorisation to close the new coffin. By way of derogation from article R. 2213-34, and subject to the sixth paragraph of this article, it also constitutes authorisation for cremation.

The mayor shall rule on the request for authorisation within six days of receipt of the request.

III.-Coffins are opened, changed and closed by a funeral operator authorised under article L. 2223-23, in a room mentioned in 1° or 2° of article R. 2223-132, outside the presence of any member of the public. The provisions of article R. 2213-45 shall apply. The closing of the new coffin immediately follows the change of coffin.

The suitability of the new coffin is assessed with regard to Article R. 2213-25.

The opening and changing of coffins is carried out in compliance with the provisions of Part IV of the Labour Code, in particular those relating to the use of work equipment and means of protection as well as those aimed at preventing biological risks, provided for respectively in Title II of Book III and Title II of Book IV of this part. Personnel responsible for carrying out operations are equipped with a surgical mask, gloves and a protective apron.

Cremation takes place without delay after the coffin has been changed.

Article R2213-34-1

I.-Lorsque le corps du défunt a été placé, pour assurer son transport, dans un cercueil composé d’un matériau présentant un obstacle à la crémation, l’autorisation de transfert du corps vers un cercueil adapté à la crémation, prévue à l’article L. 2223-42-1, est délivrée par le maire de la commune du lieu d’ouverture et de changement de cercueil, sur demande de la personne ayant qualité pour pourvoir aux funérailles.

La demande est présentée par écrit et transmise par tout moyen. Elle est accompagnée des justifications prévues à l’article R. 2213-34 et d’un certificat médical attestant que le défunt n’était pas atteint d’une infection transmissible figurant sur les listes mentionnées aux a et b de l’article R. 2213-2-1. Ce certificat est établi par un professionnel de santé exerçant sur le lieu du décès.

II.-Au vu des justifications requises et sous réserve des dispositions du 3° de l’article R. 2213-26, le maire délivre l’autorisation de transfert du corps vers un cercueil adapté à la crémation. Cette autorisation est établie sans frais et peut être adressée par voie dématérialisée. Elle vaut autorisation de fermeture du nouveau cercueil. Par dérogation à l’article R. 2213-34, et sous réserve du sixième alinéa de cet article, elle vaut également autorisation de crémation.

Le maire statue sur la demande d’autorisation dans un délai de six jours à compter de la réception de cette demande.

III.-L’ouverture, le changement et la fermeture de cercueil sont effectués par un opérateur funéraire habilité au titre de l’article L. 2223-23, dans un local mentionné au 1° ou 2° de l’article R. 2223-132, en dehors de la présence de tout public. Les dispositions de l’article R. 2213-45 sont applicables. La fermeture du nouveau cercueil suit immédiatement le changement de cercueil.

Le caractère adapté du nouveau cercueil s’apprécie au regard de l’article R. 2213-25.

L’ouverture et le changement de cercueil se déroulent dans le respect des dispositions de la quatrième partie du code du travail, en particulier de celles relatives à l’utilisation des équipements de travail et des moyens de protection ainsi que de celles visant à la prévention des risques biologiques, prévues respectivement au titre II du livre III et au titre II du livre IV de cette partie. Les personnels chargés de la réalisation des opérations sont équipés d’un masque chirurgical, de gants et d’un tablier de protection.

La crémation s’opère sans délai après le changement de cercueil.
