Article R2221-11 of the French General Code of Local Authorities

The duties of director are incompatible with a mandate as senator, deputy or representative in the European Parliament. They are also incompatible with a mandate as councillor to the Corsican Assembly, regional councillor, departmental councillor, municipal councillor, Paris councillor or arrondissement councillor held in the community or communities concerned or in a constituency including this or these communities.

The duties of director are incompatible with those of member of the board of directors or operating board of the régie.

The director may not take or retain any interest in companies related to the public service authority, hold any position in these companies, or provide services on their behalf.

In the event of a breach of these prohibitions, the director shall be removed from office either by the mayor or by the prefect. He shall be replaced immediately.

Les fonctions de directeur sont incompatibles avec un mandat de sénateur, député, représentant au Parlement européen. Elles sont également incompatibles avec un mandat de conseiller à l’Assemblée de Corse, conseiller régional, conseiller départemental, conseiller municipal, conseiller de Paris ou conseiller d’arrondissement détenu dans la ou les collectivités intéressées ou dans une circonscription incluant cette ou ces collectivités.

Les fonctions de directeur sont incompatibles avec celles de membre du conseil d’administration ou du conseil d’exploitation de la régie.

Le directeur ne peut prendre ou conserver aucun intérêt dans des entreprises en rapport avec la régie, occuper aucune fonction dans ces entreprises, ni assurer des prestations pour leur compte.

En cas d’infraction à ces interdictions, le directeur est démis de ses fonctions soit par le maire, soit par le préfet. Il est immédiatement remplacé.
