Article R6123-122 of the French Public Health Code

I.-The holder of the authorisation organises both full inpatient and part-time care.

If the holder can only offer one form of care, it offers the other form by means of an agreement with another establishment authorised to do so.

II -When the care provided in the establishment can only involve full hospitalisation, an authorisation derogating from I may be granted.

I.-Le titulaire de l’autorisation organise un mode de prise en charge en hospitalisation complète et à temps partiel.

Si le titulaire ne peut proposer qu’un seul mode de prise en charge, il propose l’autre mode grâce à une convention avec un autre établissement autorisé pour celui-ci.

II.-Lorsque les prises en charges effectuées dans l’établissement ne peuvent relever que de la seule hospitalisation complète, une autorisation dérogeant au I peut être accordée.
