Title VI: Provision of health data

Data from the national health data system that is made available to the public is processed to take the form of aggregated statistics or individual data constituted in such a way that it is impossible to identify, directly or indirectly, the persons concerned. I.-Access to personal data in the national health data system may only be authorised for the purposes of processing: 1° Contributing to a purpose mentioned in III of Article L. 1461-1 and meeting a public interest requirement; 2° or necessary for the performance of the tasks of the competent State services, public establishments or bodies entrusted with a public service mission, under the conditions defined in III of this article….

The national health data system does not contain the surnames and forenames of individuals, nor their registration number in the national register for the identification of natural persons, nor their address. The identification numbers of healthcare professionals are kept and managed separately from other data.

Access to health data other than that mentioned in Article L. 1461-2 is free of charge for : 1° The processing of data concerning health requested by the public authorities ; 2° Research carried out exclusively for the needs of public administrative services.

For the processing mentioned in articles 65 and 72 of law no. 78-17 of 6 January 1978 relating to information technology, files and civil liberties, the provision of data from the components of the national health data system mentioned in 1° to 11° of I of article L. 1461-1 is governed by this chapter.
