Chapter IV: Disciplinary chambers of first instance and regional and inter-regional councils

The president of the regional or inter-regional council appoints a rapporteur. The practitioner concerned, the departmental council and, where applicable, the national council are convened by registered letter with acknowledgement of receipt at least eight days before the meeting of the regional or inter-regional council. The decision of the regional or inter-regional council is notified by registered letter with acknowledgement of receipt to the practitioner concerned, to the departmental council, to the national council, to the director general of the regional health agency and, for practitioners in one of the statutory situations mentioned in article L. 4061-3, to the armed forces health service. The provisions of articles R. 4124-3-1 and R. 4124-3-2 are applicable before the national council. Its decision is also notified to the regional or inter-regional council. The notification shall state that the decision may be appealed on grounds of ultra vires before the Conseil d’Etat within two months.

A practitioner whose right to practise has been suspended may not resume practising unless the regional or inter-regional council has, at the request of the person concerned, arranged for a new assessment to be carried out by experts appointed in accordance with the procedures defined in II, III and IV ofarticle R. 4124-3, within the two months preceding the expiry of the period of suspension.
