The members of the National Commission are appointed by order of the Minister of Labour. The members of the regional sections and those of the sections with interdepartmental jurisdiction are appointed by order of the regional prefect. The members of the departmental sections are appointed by order of the prefect.
Employers’ and employees’ representatives on the committees and sections are appointed on the proposal of nationally representative employers’ and employees’ trade unions. These organisations submit to the appointing authority lists containing twice as many names as there are posts to be filled. Before making the appointments, the Prefect will seek the opinion of the Regional or Departmental Director of Labour, Employment and Vocational Training.
Twice as many alternate members are appointed under the same conditions as the full members. They sit only in the absence of the full members. The full and alternate representatives of employers and employees within the regional, interdepartmental and departmental sections are chosen from among employers and employees who actually carry on their professional activity within the jurisdiction of these sections.
Committee members must not have been disqualified, disqualified or disqualified from holding public office.
In the event of recourse by the parties to the conciliation procedure, the most diligent party sends the chairman of the commission a request setting out the points of disagreement. If a party who has been duly summoned fails to appear at the next meeting without a legitimate reason, the Chairman will draw up a report on the failure to appear. These minutes indicate the points of disagreement specified by the party present or represented. The failure of the party that filed the request for conciliation to appear shall be deemed to constitute a waiver of the request.
When an agreement is reached before a conciliation commission, the chairman draws up and notifies the parties of the minutes. The minutes are sent within twenty-four hours to the Minister responsible for labour and to the regional or departmental prefect.
