Title III: Provisions specific to the territorial collectivity of Saint-Pierre-et-Miquelon

For the purposes of Article 240, the criminal court is composed of the court proper and the jury.

For the purposes of Article 243, the court itself comprises the president and the assessors.

For the application of article 244, the criminal court is presided over by the president of the tribunal supérieur d’appel. In the event of a vacancy, absence, impediment or legal incompatibility, the duties of president of the tribunal supérieur d’appel are performed by a judge appointed by the first president of the Paris court of appeal from a list drawn up by him for each calendar year.

For the application of Article 249, the conditions that criminal court assessors must meet are those set out in the article L. 951-2 du code de l’organisation judiciaire.

For the application of article 250, assessors are appointed by order of the president of the higher court of appeal, after consulting the public prosecutor.

For the application of article 251, in the event of an impediment occurring before or during the session, the assessors are replaced by order of the President of the High Court of Appeal.

For the application of paragraph 1 of Article 260, the number of jurors may not be less than thirty-four.

For the purposes of Article 262, the commission shall comprise: -the President of the High Court of Appeal, Chairman; -the President of the Court of First Instance; -the Public Prosecutor or his deputy; -a person approved under the conditions defined in Article 905 and appointed by the President of the High Court of Appeal ; -three territorial councillors appointed each year by the territorial council; -three municipal councillors appointed each…

For the application of article 264, a special list of ten alternate jurors is drawn up each year, outside the annual jury list and under the same conditions.

For the application of Article 266, sixteen jurors, whose names are drawn from the annual list, form the list for the session. In addition, the names of three alternate jurors are drawn from the special list.
